MindWise DBT Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using MindWise DBT ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

MindWise DBT is a digital wellness application designed to support users practicing Dialectical Behavior Therapy (DBT) skills. The App provides:

  • DBT skill exercises and educational content
  • Mood tracking and daily check-ins
  • An AI companion ("Grace") for supportive conversation
  • Progress tracking and journaling features
  • Crisis resources and safety planning tools
3. Important Medical Disclaimer

The App is not a substitute for professional medical or mental health treatment.

  • MindWise DBT is a self-help tool and educational resource, not a medical device or treatment
  • The App does not provide medical advice, diagnosis, or treatment
  • Grace, our AI companion, is not a therapist, counselor, or mental health professional
  • Always consult qualified healthcare providers for medical or mental health concerns
  • In case of emergency, call your local emergency services immediately
  • If you are experiencing a mental health crisis, please contact crisis services in your country
4. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years of age.

5. User Accounts
  • You are responsible for maintaining the confidentiality of your account credentials
  • You agree to provide accurate and complete information when creating an account
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
6. Acceptable Use

You agree NOT to:

  • Use the App for any illegal purpose
  • Misrepresent your identity or affiliation
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Use the App to harm, threaten, or harass others
  • Share content that is defamatory, obscene, or violates others' rights
  • Use automated systems to access the App without permission
  • Reverse engineer, decompile, or disassemble any part of the App
7. AI Companion (Grace)
  • Grace is an AI-powered conversational companion, not a human or licensed professional
  • Grace's responses are generated by artificial intelligence and may not always be accurate or appropriate
  • You should not rely solely on Grace for crisis support or mental health treatment
  • We continuously work to improve Grace's safety and helpfulness, but no AI system is perfect
  • By using Grace, you acknowledge these limitations and agree to use the feature responsibly
8. User Content
  • You retain ownership of content you create in the App (journal entries, diary cards, etc.)
  • You grant us a limited license to store, process, and display your content to provide the Service
  • You are responsible for the content you create and share
  • We may remove content that violates these Terms
9. Caregiver and Therapist Features

If you use features to share information with caregivers or therapists:

  • You consent to sharing the specified data with your designated contacts
  • You are responsible for ensuring your contacts are appropriate recipients
  • Shared information is subject to our Privacy Policy
  • You may revoke sharing permissions at any time
10. Intellectual Property
  • The App, including its design, content, features, and underlying technology, is owned by MindWise DBT
  • DBT concepts and techniques are based on the work of Dr. Marsha Linehan and are used for educational purposes
  • You may not copy, modify, distribute, or create derivative works from the App without permission
  • "MindWise DBT," "Grace," and associated logos are trademarks of MindWise DBT
11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, WILL MEET YOUR SPECIFIC REQUIREMENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDWISE DBT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, ANY LOSS OF DATA, PROFITS, OR GOODWILL, OR ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

13. Indemnification

You agree to indemnify and hold harmless MindWise DBT, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

14. Termination
  • You may terminate your account at any time through the App settings
  • We may suspend or terminate your access for violation of these Terms
  • Upon termination, your right to use the App ceases immediately
  • You may request deletion of your data as described in our Privacy Policy
  • Under GDPR, you have the right to erasure of your personal data upon termination
15. HIPAA Compliance (United States)

For users in the United States, the following HIPAA-related terms apply:

  • Your health information in the App (mood tracking, diary entries, crisis plans) is treated as Protected Health Information (PHI)
  • We implement administrative, physical, and technical safeguards to protect your PHI
  • We will not use or disclose your PHI except as permitted by these Terms, our Privacy Policy, or as authorized by you
  • You have the right to access, amend, and receive an accounting of disclosures of your PHI
  • We will notify you within 60 days of discovering any breach of your unsecured PHI
  • Third-party service providers with access to PHI operate under Business Associate Agreements
16. GDPR Compliance (EEA/UK)

For users in the European Economic Area, United Kingdom, and other jurisdictions where GDPR applies:

  • We process your personal data lawfully, fairly, and transparently
  • Health data is processed as "special category data" only with your explicit consent
  • You have rights to access, rectification, erasure, restriction, portability, and objection
  • You may withdraw consent at any time without affecting the lawfulness of prior processing
  • International data transfers are protected by Standard Contractual Clauses
  • You have the right to lodge a complaint with your local supervisory authority
  • We will respond to data subject requests within 30 days
  • We implement data protection by design and by default
17. Data Protection Rights by Region
  • United States: Rights under HIPAA and applicable state privacy laws (e.g., CCPA for California residents)
  • United Kingdom: Rights under UK GDPR and Data Protection Act 2018. Contact: ICO (ico.org.uk)
  • Spain: Rights under EU GDPR. Contact: AEPD (aepd.es)
  • Argentina: Rights under Personal Data Protection Law 25.326. Contact: AAIP (argentina.gob.ar/aaip)
18. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email at least 30 days before changes take effect. For GDPR users, changes to data processing will require renewed consent where applicable. Your continued use of the App after changes become effective constitutes acceptance of the new Terms.

19. Governing Law and Dispute Resolution

These Terms are governed by the applicable laws of the jurisdiction in which you reside, provided that jurisdiction is one of the following: United States, United Kingdom, Spain, or Argentina.

  • United States: Federal and state laws apply; disputes resolved in federal or state courts
  • United Kingdom: UK law applies; GDPR rights are preserved regardless of dispute resolution
  • Spain: Spanish law and EU regulations apply
  • Argentina: Argentine law applies; consumer protection rights are preserved
20. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect. This includes any provision that may conflict with mandatory local laws, which shall be modified to the minimum extent necessary.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MindWise DBT regarding the App. Nothing in these Terms affects your statutory rights under HIPAA, GDPR, or other applicable data protection laws.
